MINUTES OF THE LARIMER COUNTY BOARD OF ADJUSTMENT
(December 28, 2010)
The regular meeting of the Larimer County Board of Adjustment was held in the County Board Hearing Room in the Larimer County Courthouse Offices, Fort Collins, Colorado at 7:00 p.m., December 28, 2010 at which time the following business was transacted.
Board Members Present: Timothy Jaworski, Peter Bohling, Alan Cram, Carol Dowding, and Jeffrey Schneider
Staff Present: Toby Stauffer, Staff Planner, and Jeannine Haag, Deputy County Attorney
Minutes: Peter Bohling moved and Carol Dowding seconded the Motion to approve the November 16, 2010 Minutes of the Larimer County Board of Adjustment as presented. Board members Timothy Jaworski, Peter Bohling, Alan Cram, Carol Dowding, and Jeffrey Schneider voted in favor of the Motion. The Minutes were unanimously approved.
Findings and Resolutions: Carol Dowding moved and Peter Bohling seconded the Motion to approve the following Findings and Resolutions: Haines Setback Variance (#10-BOA0826), Johnson Setback Variance (#10-BOA0825), Martinez Setback Variance (#10-BOA0829), Northen Setback Variance (#10-BOA0828), and Schmaltz Setback Variance (#10-BOA0827). Board members Timothy Jaworski, Peter Bohling, Alan Cram, Carol Dowding, and Jeffrey Schneider voted in favor of the Motion.

Request: The Application of Tim Ortiz, requesting a variance, was presented to the Board. The Application requested a setback variance to allow an existing outbuilding to be located 35 feet from Dry Creek rather than the required minimum of 100 feet in the O-Open zone.
Action: Peter Bohling moved and Carol Dowding seconded the Motion to approve the Application with conditions. Board members Timothy Jaworski, Peter Bohling, Alan Cram, Carol Dowding, and Jeffrey Schneider voted in favor of the Motion. The Application was approved with conditions.

Request: The Application of Robert Keirns, requesting a variance, was presented to the Board. The Application requested a setback variance to allow a proposed storage building to be located 71 feet from the centerline of South County Road 7 rather than the required minimum of 100 feet in the FA-Farming zone.
Action: Peter Bohling moved and Timothy Jaworski seconded the Motion to approve the Application with conditions. Board members Timothy Jaworski and Peter Bohling voted in favor of the Motion. Members Alan Cram, Carol Dowding, and Jeffrey Schneider voted against the Motion. The Application was denied for failure to receive the requisite four votes in favor.

Request: The Application of Joe Anders, requesting a variance, was presented to the Board. The Application requested a setback variance to allow a side setback for a deck to be located 37.7 feet from the north lot line rather than the required minimum of 50 feet in the E- Estate zone.
Action: Peter Bohling moved and Carol Dowding seconded the Motion to approve the Application with conditions. Board members Timothy Jaworski, Peter Bohling, Alan Cram, Carol Dowding, and Jeffrey Schneider voted in favor of the Motion. The Application was approved with conditions.

The Application requested a setback variance to allow a proposed addition to be located 5 feet from the south property line and access easement rather than the required minimum of 25 feet and to allow an existing house to be located 5 feet from the east property line rather than the required minimum of 10 feet in the O-Open zone.
Action: Peter Bohling moved and Carol Dowding seconded the Motion to approve the Application with conditions. Board members Timothy Jaworski, Peter Bohling, Alan Cram, Carol Dowding, and Jeffrey Schneider voted in favor of the Motion. The Application was approved with conditions.

Action: Peter Bohling moved and Carol Dowding seconded the Motion to approve the Application with conditions. Board members Timothy Jaworski, Peter Bohling, Alan Cram, Carol Dowding, and Jeffrey Schneider voted in favor of the Motion. The Application was approved with conditions.

The Application requested a setback variance to allow a rebuilt covered deck to be located 19 feet from the McColm Street and the front property line rather than the required minimum of 25 feet in the O-Open zone.
Action: Peter Bohling moved and Carol Dowding seconded the Motion to approve the Application with conditions. Board members Timothy Jaworski, Peter Bohling, Alan Cram, Carol Dowding, and Jeffrey Schneider voted in favor of the Motion. The Application was approved with conditions.
