LARIMER COUNTY PLANNING COMMISSION

Minutes of June 15, 2011

 

The Larimer County Planning Commission met in a regular session on Wednesday, June 15, 2011, at 6:30 p.m. in the Hearing Room.  Commissioners’ Cox, Dougherty, Glick, Miller, and Wallace, were present.  Commissioner Hart presided as Chairman.  Commissioners Gerrard and Hess were absent.  Also present were Matt Lafferty, Principle Planner, Tom Garton, Chief Building Official, Chad Gray, Code Compliance Officer, and Jill Wilson, Planning Technician and Recording Secretary. 

 

COMMENTS BY THE PUBLIC REGARDING THE COUNTY LAND USE CODE: 

None

 

COMMENTS BY THE PUBLIC REGARDING OTHER RELEVANT LAND USE MATTERS NOT ON THE AGENDA:  

None.

 

APPROVAL OF THE MINUTES FOR THE APRIL 20, 2010 MEETINGS:   MOTION by Commissioner Cox approve the minutes, seconded by Commissioner Glick.  This received unanimous voice approval.

 

AMENDMENTS TO THE AGENDA:

None.

 

ITEMS:

 

ITEM #1  ADOPTION OF THE 2009 INTERNATIONAL BUILDING CODES:   Mr. Gray provided background information on the request to adopt the 2009 International Residential Code, 2009 International Building Code , 2009 International Plumbing Code, 2009 International Mechanical Code, 2009 International Fuel Gas Code, 2009 International Energy Conservation Code , 2009 International Existing Building Code, all with proposed amendments, the 1997 Uniform Code for the Abatement of Dangerous Buildings, the National Green Building Standard (ICC 700) as the standard for a Larimer County voluntary green building program for one- and two-family dwellings, an amendment to Building Permit Fee Schedule Table 1-A, and  repealing the currently adopted 2006 International Residential Code, 2006 International Building Code , 2006 International Plumbing Code, 2006 International Mechanical Code, 2006 International Fuel Gas Code, 2006 International Energy Conservation Code, 2006 International Existing Building Code and proposed amendments, all to be effective July 31, 2011.

 

Chairman Hart noted that the items had been reviewed at worksession with the Planning Commission and Board of County Commissioners.

 

PUBLIC TESTIMONY:

DISCUSSION:

Commissioner Dougherty asked if the City of Fort Collins adopted the 2009 International Building Codes.

 

Mr. Gray replied yes with their adopted amendments.

 

Commissioner Cox moved that the Planning Commission adopt the following Resolution:

 

BE IT RESOLVED that the Planning Commission recommend to the Board of County Commissioners the adoption of the 2009 International Residential Code, 2009 International Building Code, 2009 International Plumbing Code, 2009 International Mechanical Code, 2009 International Fuel Gas Code, 2009 International Energy Conservation Code, 2009 International Existing Building Code, with proposed amendments, the 1997 Uniform Code for the Abatement of Dangerous Buildings, the most current published National Green Building Standard (ICC 700) as the standard for a Larimer County voluntary green building program for 1 & 2 family dwellings, with an amendment to the Building Permit Fee Schedule Table 1-A “Other Inspection and Fees”, all to be effective July 31, 2011.

 

Commissioner Glick seconded the Motion.

 

Commissioners’ Cox, Dougherty, Glick, Miller, Wallace and Chairman Hart voted in favor of the Motion.

 

MOTION PASSED:  6-0

 

 

Commissioner Cox moved that the Planning Commission adopt the following Resolution:

 

BE IT RESOLVED that the Planning Commission recommend to the Board of County Commissioners repeal the currently adopted 2006 International Residential Code, 2006 International Building Code, 2006 International Plumbing Code, 2006 International Mechanical Code, 2006 International Fuel Gas Code, 2006 International Energy Conservation Code, 2006 International Existing Building Code and proposed amendments, all to be effective July 31, 2011.

 

Commissioner Glick seconded the Motion.

 

Commissioners’ Cox, Dougherty, Glick, Miller, Wallace and Chairman Hart voted in favor of the Motion.

 

MOTION PASSED:  6-0

 

 

 

Commissioner Cox moved that the Planning Commission adopt the following Resolution:

 

BE IT RESOLVED that the Planning Commission recommend to the Board of County Commissioners adopt the most current published National Green Building Standard (ICC 700) as the standard for a Larimer County voluntary green building program for one- and two-family dwellings.

 

Commissioner Glick seconded the Motion.

 

Commissioners’ Cox, Dougherty, Glick, Miller, Wallace and Chairman Hart voted in favor of the Motion.

 

MOTION PASSED:  6-0

 

 

Commissioner Cox moved that the Planning Commission adopt the following Resolution:

 

BE IT RESOLVED that the Planning Commission recommend to the Board of County Commissioners to a mend the Building Permit Fee Schedule Table 1-A “Other Inspection and Fees”, Item # 5—Issuance of each Temporary Certificate of Occupancy, to  read as follows:

 

            Issuance of each Temporary Certificate of Occupancy (TCO) and extensions . . . 600*.              

* A Temporary Certificate of Occupancy shall be valid for six months.   If a full Certificate of Occupancy is issued within the first month, all but $40 will be refunded.  If a full Certificate of Occupancy is issued prior to the six month expiration, $100 shall be refunded for each full month remaining out of the original six month validity period of the Temporary Certificate of Occupancy.

 

Commissioner Glick seconded the Motion.

 

Commissioners’ Cox, Dougherty, Gerrard, Glick, Hess, Miller, Wallace and Chairman Hart voted in favor of the Motion.

 

MOTION PASSED:  6-0

 

Commissioner Wallace requested that a 1041 permit for reservoirs be discussed at the next worksession.

 

All commission members agreed.

 

 

 

 

 

REPORT FROM STAFF:  Mr. Lafferty reminded the Commission of their upcoming meetings. 

 

ADJOURNMENT:   There being no further business, the hearing adjourned at 6:40 p.m.
