MINUTES OF THE LARIMER COUNTY BOARD OF ADJUSTMENT

(August 24, 2010)

 

 The regular meeting of the Larimer County Board of Adjustment was held in the County Board Hearing Room in the Larimer County Courthouse Offices, Fort Collins, Colorado at 7:00 p.m., August 24, 2010 at which time the following business was transacted.  

 

Board Members Present: Carol Dowding, Peter Bohling, Alan Cram, Jeffrey Schneider, and Tim Jaworsky

 

Staff Present: Toby Stauffer, Staff Planner and Jeannine Haag, Deputy County Attorney

 

Minutes:  Peter Bohling moved and Jeffrey Schneider seconded the Motion to approve the July 27, 2010 Minutes of the Larimer County Board of Adjustment as presented. Board members Carol Dowding, Peter Bohling, Alan Cram, Jeffrey Schneider, and Tim Jaworsky voted in favor of the Motion.  The Minutes were unanimously approved.

 

Findings and Resolutions:  Peter Bohling moved and Carol Dowding seconded the Motion to approve the Findings and Resolution for the Powers Setback Variance (#10-BOA0803).  Board members Carol Dowding, Peter Bohling, Alan Cram, Jeffrey Schneider, and Tim Jaworsky voted in favor of the Motion.

 

Peter Bohling moved and Jeffrey Schneider seconded the Motion to approve the Findings and Resolution for the Schupbach Setback Variance (#10-BOA0804).  Board members Carol Dowding, Peter Bohling, Alan Cram, Jeffrey Schneider, and Tim Jaworsky voted in favor of the Motion.

 

Peter Bohling moved and Jeffrey Schneider seconded the Motion to approve the Findings and Resolution for the Lower Poudre Canyon Setback Variance (#10-BOA0800).  Board members Carol Dowding, Peter Bohling, Alan Cram, Jeffrey Schneider, and Tim Jaworsky voted in favor of the Motion.

Request: The Application of Thomas Watts, requesting a variance was presented to the Board.  The application requested a setback variance to allow an existing barn to be 0.4 feet from the property line between Tracts A and B in the Warren Exemption rather than the required minimum of 25 feet in the O-Open zone.

 

Action:  Peter Bohling moved and Carol Dowding seconded the Motion to approve the Application (with conditions).  Board members Carol Dowding, Peter Bohling, Alan Cram, Jeffrey Schneider, and Tim Jaworsky voted in favor of the Motion.  The Application was approved with conditions.

Request:  The Application of Gary Sapp, requesting a variance was presented to the Board.  The Application requested a setback variance to allow an existing deck to be 4 feet and a pergola to be 1.6 feet from the front property line rather than the required minimum of 25 feet in the RFLB-Red Feather Lakes Business zoning district.

 

Action:  Carol Dowding moved and Peter Bohling seconded the Motion to approve the Application with conditions.  Board members Carol Dowding, Peter Bohling, Alan Cram, Jeffery Schneider, and Tim Jaworsky voted in favor of the Motion. The Application was approved with conditions.

Request:  The Application of Jerry Chevalier, requesting a variance was presented to the Board.  The Application requested a setback variance to allow a proposed garage to be 18 feet from the deeded right-of-way centerline for County Road 29, and 48 feet from the existing road centerline rather than the required minimum of 70 feet from a Minor Collector in the FA-1 Farming zone.

 

Action:  Peter Bohling moved and Carol Dowding seconded the Motion to approve the Application with conditions.  Board members Carol Dowding, Peter Bohling, Alan Cram, Jeffrey Schneider, and Tim Jaworsky voted in favor of the Motion.  The Application was approved with conditions.

Applicant:  Brian Pearson

Request: The Application of Brian Pearson, requesting a variance was presented to the Board.  The Application requested a setback variance to allow an existing house and a proposed addition to be 38 feet from the centerline of County Road 22H, instead of the 60 feet required for a Local Numbered County Road in the FA-1 Farming zone.

 

Action:  Peter Bohling moved and Carol Dowding seconded the Motion to approve the Application with conditions.  Board members Carol Dowding, Peter Bohling, Alan Cram, Jeffrey Schneider, and Tim Jaworsky voted in favor of the Motion.  The Application was approved with conditions.

Owner:  Jeffrey and Sarah Bassler

Applicant:  Jeffrey and Sarah Bassler

Request:  The Application of Jeffrey and Sarah Bassler, requesting a variance was presented to the Board.  The Application requested a setback variance to allow a proposed garage to be 16 feet and 10 feet from the rear property lines rather than the required minimum of 25 feet in the R-Residential zone.

 

Action:  Peter Bohling moved and Carol Dowding seconded the Motion to approve the Application with conditions.  Board members Carol Dowding, Peter Bohling, Alan Cram, Jeffrey Schneider, and Tim Jaworsky voted in favor of the Motion. The Application was approved with conditions.   

 

File No: #10-BOA0800  (Lower Poudre Canyon Setback Variance)

 

 A request to table the Lower Poudre Canyon Setback Variance was made by the applicant.

 

  Peter Bohling moved and Carol Dowding seconded the motion that the Board table this matter until September 28, 2010 at 7:00 p.m.

 

  The question was called and members, Carol Dowding, Peter Bohling, Alan Cram, Jeffrey Schneider, and Tim Jaworsky voted in favor of the motion. 

 

Adjournment:  The meeting was adjourned at 7:25 p.m.
