MINUTES OF THE LARIMER COUNTY BOARD OF ADJUSTMENT

(April 27, 2010)

The regular meeting of the Larimer County Board of Adjustment was held in the County Board Hearing Room in the Larimer County Courthouse, Fort Collins, Colorado at 7:00 p.m., April 27, 2010, at which time the following business was transacted.

Board Members Present: Jeffrey Schneider, Eric Berglund, Alan Cram, Greg Christensen, Evelyn King

Staff Present: Toby Stauffer, Planner, and William G. Ressue, Assistant County Attorney

Minutes: Alan Cram moved and Jeffrey Schneider seconded the Motion to approve the March 23, 2010 Minutes of the Larimer County Board of Adjustment as presented. Board members Jeffrey Schneider, Eric Berglund, Alan Cram and Evelyn King voted in favor of the Motion. Member Greg Christensen abstained from voting. The Minutes were unanimously approved.

Findings and Resolutions: Alan Cram moved and Jeffrey Schneider seconded the Motion to approve the following Findings and Resolutions: Stocker Setback Variance (#10-BOA0782) and Miller Setback Variance (#10-BOA0783). Board members Jeffrey Schneider, Eric Berglund, Alan Cram, and Evelyn King voted in favor of the Motion. Member Greg Christensen abstained from voting.

Applications:

File No: #10-BOA0786 (W.O.L.F. Setback Variance)

Owner: W.O.L.F., a nonprofit corporation

Applicant: Frank Wendland

Request: The Application of Frank Wendland, requesting a variance was presented to the Board. The Application requested a setback variance to allow a cabin to remain 39 feet from the centerline of a stream and for two existing sheds to remain 45 feet and 62 feet from the centerline of the same stream rather than the required minimum of 100 feet from the stream centerline in the O-Open zone.

Action: Greg Christensen moved and Evelyn King seconded the Motion to approve the Application with conditions. Board members Jeffrey Schneider, Eric Berglund, Alan Cram, Greg Christensen, and Evelyn King voted in favor of the Motion. The Application was approved with conditions.

Applicant: Shannon Doyle

Request: The Application of Shannon Doyle, requesting a variance was presented to the Board. The Application requested a setback variance to allow the existing residence and an addition to the west be setback 72 feet from the centerline of Highway 14 instead of the required minimum of 100 feet from the centerline; to allow the existing residence and an addition to the

northeast to be setback from the side property line 19 instead of the required minimum of 5 feet from the side property line in the O-Open zone.

Action: Greg Christensen moved and Evelyn King seconded the Motion to approve the Application with conditions. Board members Jeffrey Schneider, Eric Berglund, Alan Cram, Greg Christensen, and Evelyn King voted in favor of the Motion. The Application was approved with conditions.

Owner: Melvin and Sherlene Moyer

Applicant: Melvin and Sherlene Moyer

Request: The Application of Melvin and Sherlene Moyer, requesting a variance was presented to the Board. The Application requested a setback variance to allow a carport to be setback 2 feet from the east property line rather than the required minimum 7 feet, the rear shed to be 2 feet from the rear property line rather than the required minimum 25 feet and the west side patio/porch to be 2 feet from the property line rather than the required minimum 7 feet in the R-1 Residential zone.

Action: Greg Christensen moved and Evelyn King seconded the Motion to approve the Application with conditions. Board members Jeffrey Schneider, Eric Berglund, Alan Cram, Greg Christensen, and Evelyn King voted in favor of the Motion. The Application was approved with conditions.

Adjournment: The meeting was adjourned at 7:06 p.m.
