Discussion Items:

EAB Issue Index:   The members reviewed their Issue Index, with emphasis on those items that are currently shown as ‘active’ review status.  The results of those discussions are shown on the chart attached to these minutes.  Doug Ryan will update the Index to reflect decisions made by the Advisory Board.  As part of the discussion Jennifer Lee moved, and Kate Muldoon seconded a motion to authorize a memo to the County Commissioners offering the EAB’s services to evaluate future ozone action planning and control activities.  That motion passed unanimously. 

 

EAB 2011 Work Plan:   A work plan for 2011 will be a part of the Advisory Board’s 2010 Annual Report.  Members reviewed their 2010 plan, and made updates to reflect the status of current event topics.  Doug Ryan will prepare the work plan for inclusion in the annual report. 

 

Approval of October Minutes:

The minutes from the October 12 EAB meeting were approved as presented.

 

Election of Officers for 2011:

Jennifer Lee was elected as chair, and Melissa Chalona as vice-chair for 2011.

 

Updates:

Kimberly Karish provided a brief update on the status of preparations for the EIS draft Environmental Impact Statement (EIS) for the proposed draping of artistic fabric on the Arkansas River by the artist Christo. The current emphasis is on preparation of the purpose and need statement. 

 

EAB Issue Index:

Doug Ryan will update the Issue Index related to the topics discussed at the meeting.

 

BCC Communication Issues:

Doug Ryan and Melissa Chalona will work together to prepare a memo to the Commissioners regarding ozone air quality review issues.

1.03 Domestic Animal Standards: The EAB reviewed proposed Land Use Code regulatory language for horse boarding facilities, and the related Resource Stewardship Plan guidance at several meetings in 2010.  The regulations have been modified, and the County is ready to accept applications for review.

Retain active status and review for “lessons learned” or needed adjustments as requested by planning staff

2.04 Maxwell Ranch Wind Farm:   Project withdrawn by CSU, but anticipating a re-submittal in the future.  This project is unique because it will be regulated under the Land Use Code, and is adjacent to County open space.

2.05 Bald Mountain Radio Tower:  The EAB reviewed the potential County sponsored project in 2010 and advised the BCC on environmental issues.  The County is pursuing environmental studies with the Forest Service to determine the extent of evaluation needed for a future NEPA permitting decision by the forest service.

3.07 Magnesium chloride for road treatment:   MgCl2 on County mountain gravel roads has been restricted.  Experience with the substitute X-hesion® less satisfactory than hoped.  Ongoing studies with CSU have been expanded to more mountain/plains gravel roads.  Very limited use of MgCl2 in conjunction with winter sanding on plowed paved roadways. 

Retain active status, and ask Public Works Department to update the EAB as studies are completed

 

4.01 Recycling & 4.03 Solid Waste/Landfill Operations:   Last update was September 2010.  Major emphasis regarding changes was on methane gas monitoring and control.

4.04 Alps Tire Pile cleanup:   Majority of approximately 5 million tires have been removed under the Department of Local Affairs (DOLA) grant.  Serious environmental hazard mitigated.  The Colorado Department of Health & Environment (CDPHE) was working in late 2010 on compliance orders for finishing this project.

Consider review status based on anticipated CDPHE compliance reports in early 2011

6.02 Water storage or Management Projects (NISP & the related 3.06 Highway 287 bypass): A Supplemental Draft EIS is under preparation for an anticipated release by the Army Corps of Engineers in mid-2011. 

Keep the active category, and consult with the BCC on their expectations for review by boards & commissions

6.02  Water storage or Management Projects (Regional Watershed Supply Project):   This project is currently under evaluation for the Purpose & Need by the Army Corps of Engineers.  It would take water from the Green River in Wyoming and pipe it to Front Range users.

8.01 Environmental Stewardship Awards:   The awards ceremony for 2010 was held on December 13.

Keep active category, and appoint a 2011 awards committee in August

9.02 Ozone:  The region is currently in non-attainment status for the 8-hour ozone air quality standard, and is operating under the provisions of a 2008 Ozone Action Plan and related air quality rules.  Vehicle Inspection & Maintenance was reintroduced to the North Front Range in November 2010.  Planning is underway on a new Ozone Action Plan to address new more stringent ozone standards.

Propose to the BCC that the EAB is able to review planning for the new Ozone Action Plan in order to provide recommendations to the BCC on emission control issues during the planning process.

10.03 Uranium Mining:  The EAB prepared a white paper on in-situ uranium mining for the Commissioners in 2008.  Following recent regulatory updates at the State level, it is anticipated that a permit application for mining in Weld County will be submitted in 2011.

Retain the active category and consult with the BCC on any requested review activities.

12.02 Green Objectives:  Based on federal stimulus grants, the County hired an energy coordinator in 2009.  The EAB received two updates the energy policy and plan in 2010.

18.03 West Nile Virus:  Each year the EAB receives an update from the Department of Health regarding WNV and other zoonotic diseases such as rabies and hantavirus that occur in the County and Colorado.

Retain annual mid-season update on WNV and other zoonotic diseases.
