MINUTES OF THE LARIMER COUNTY BOARD OF ADJUSTMENT

(June 23, 2009)

 

            The regular meeting of the Larimer County Board of Adjustment was held in the County Board Hearing Room in the Larimer County Courthouse, Fort Collins, Colorado at 7:00 p.m., June 23, 2009 at which time the following business was transacted. 

 

Board Members Present:         Matt Strauch, Evelyn King, Greg Christensen,                                                                      and Jean Christman

 

Board Members Absent:         Eric Berglund

 

Alternate Members Present:    Alan Cram

 

Alternate Members Absent:    Peter Bohling

Minutes:  Greg Christensen moved and Matt Strauch seconded the Motion to approve the May 26, 2009 Minutes of the Larimer County Board of Adjustment with one correction to the Levick Setback Variance.  The Levick Setback Variance was corrected to state that the motion to continue was seconded by Member Strauch, not by Member Christensen.  Board members Matt Strauch, Alan Cram, Evelyn King, Greg Christensen, and Jean Christman voted in favor of the Motion.  The Minutes as corrected were unanimously approved.

 

Findings and Resolutions: Jean Christman moved and Greg Christensen seconded the Motion to approve the Findings and Resolution approving the Whitaker Setback Variance (#09-BOA0750), the Findings and Resolution approving the Muniz Setback Variance (#09-BOA0751), and the Findings and Resolution approving the Howe Setback Variance (#09-BOA0752). Board members Matt Strauch, Alan Cram, Evelyn King, Greg Christensen, and Jean Christman voted in favor of the Motion.  The Findings and Resolutions were unanimously approved.

File No:           #09-BOA0757  (Grueff-1 Setback Variance Extension)

Applicants:      Ed Grueff

Request:           The Application of Ed Grueff, requesting a variance, was presented to the Board.  The Application requested a one-year extension to comply with the approval of the original Grueff-1 Setback Variance File #08-BOA0696 that allowed a new single family dwelling to be located 36 feet from the centerline of Miller Fork Creek rather than the required minimum setback of 100 feet in the FO-Forestry zone.

 

Action:  Jean Christman moved and Matt Strauch seconded the Motion to approve the Application with conditions.  Board members Matt Strauch, Alan Cram, Evelyn King, Greg Christensen, and Jean Christman voted in favor of the Motion. The Application was approved with conditions. 

 

File No:           #09-BOA0756  (Runnels Setback Variance)

Owner:                        Bruce and Katherine Runnels

Applicant:       Roger Hass / Select Builders, Inc.

Request:          The Application of Roger Hass and Select Builders, Inc., requesting a variance, was presented to the Board.  The Application requested a setback variance to allow a replacement deck to be 16 feet from the rear property line rather than the required minimum of 25 feet in the R-Residential zone.

 

Action:  Jean Christman moved and Matt Strauch seconded the Motion to approve the Application with conditions.  Board members Matt Strauch, Alan Cram, Evelyn King, Greg Christensen, and Jean Christman voted in favor of the Motion. The Application was approved with conditions. 

 

File No:           #09-BOA0755 (Naber Setback Variance)

Owner:                        Mark and Diana Naber

Applicant:       Mark and Diana Naber

Request:          The Application of Mark and Diana Naber, requesting a variance, was presented to the Board.  The Application requested a setback variance to allow an addition to an existing residence to be 73 feet from the centerline of Highway 14 rather than the required minimum of 100 feet from the right-of-way centerline; to be 18 feet from the east property line, and 12 feet from the west property line rather than the required minimum of 25 feet from all property lines in the O-Open zone.

 

Action:  Jean Christman moved and Matt Strauch seconded the Motion to approve the Application with conditions.  Board members Matt Strauch, Alan Cram, Evelyn King, Greg Christensen, and Jean Christman voted in favor of the Motion. The Application was approved with conditions. 

 

File No:           #09-BOA0758  (Fuentes Amended Setback Variance)

Owner:                        Aspen Mobile Home Park, LLC

Applicant:       Yolanda Fuentes

Request:          The Application of Yolanda Fuentes, requesting a variance was presented to the Board.  The Application requested a setback variance to allow an addition to an existing manufactured home to be 68 feet 11 inches from the centerline of Overland Trail rather than the required minimum of 110 feet from the right-of-way centerline in the M-1 Multi-Family zone.

 

Action:  Jean Christman moved and Matt Strauch seconded the Motion to approve the Application with conditions.  Board members Matt Strauch, Alan Cram, Evelyn King, Greg Christensen, and Jean Christman voted in favor of the Motion. The Application was approved with conditions. 

 

Written Decisions:  For each application, the Board’s findings and decision will be reduced to writing in the form of a Resolution.  The written Resolution is the final decision by the Board and will be recorded in the records of the Larimer County Clerk and Recorder.

 

Other Matters: Staff Member Samantha Mott updated the Board on the process and procedure for Setback Variance Extensions.  The Board discussed whether requests for extensions of time to act on variances should be considered and acted on as administrative matters by the Planning Director, rather than presented as a hearing item at the Board’s monthly meeting.  The general consensus of the Board was to continue to hear and decide these requests at the Board’s monthly meeting.
