MINUTES OF THE LARIMER COUNTY BOARD OF ADJUSTMENT

(November 16, 2010)

 

The regular meeting of the Larimer County Board of Adjustment was held in the County Board Hearing Room in the Larimer County Courthouse Offices, Fort Collins, Colorado at 7:00 p.m., November 16, 2010 at which time the following business was transacted.

 

Board Members Present: Carol Dowding, Peter Bohling, Alan Cram, Paul Devenny, Jeffrey Schneider

 

Staff Present: Toby Stauffer, Staff Planner, and William G. Ressue, Assistant County Attorney

 

Minutes: Peter Bohling moved and Carol Dowding seconded the Motion to approve the October 26, 2010 Minutes of the Larimer County Board of Adjustment as presented. Board members Carol Dowding, Peter Bohling, Alan Cram, Paul Devenny, and Jeffrey Schneider voted in favor of the Motion. The Minutes were unanimously approved.

 

Findings and Resolutions: Carol Dowding moved and Peter Bohling seconded the Motion to approve the following Findings and Resolution: Mroczko Setback Variance ( #10-BOA0818). Board members Carol Dowding, Peter Bohling, Alan Cram, Paul Devenny, and Jeffrey Schneider voted in favor of the Motion.

File No: #10-BOA0826 (Haines Setback Variance)

Owner: Matt Haines

Applicant: Mike Rush

Request: The Application of Mike Rush, requesting a variance, was presented to the Board. The Application requested a setback variance to allow a replacement cabin to be located 12 feet and a proposed deck to be located 2 feet from the front property line rather than the required minimum 25 feet in the O-Open zone .

 

Action: Peter Bohling moved and Paul Devenny seconded the Motion to approve the Application with conditions. Board members Carol Dowding, Peter Bohling, Alan Cram, Paul Devenny, and Jeffrey Schneider voted in favor of the Motion. The Application was approved with conditions.

Owners/Applicants: Glenn and Jayne Johnson

Request: The Application of Glenn and Jayne Johnson, requesting a variance, was presented to the Board. The Application requested a setback variance to allow an existing house to be located 60 feet and a proposed addition to be located 105 feet from the centerline of County Road 54G rather than the required minimum of 110 feet in the O-Open zone.

 


Action: Peter Bohling moved and Paul Devenny seconded the Motion to approve the Application with conditions. Board members Carol Dowding, Peter Bohling, Alan Cram, Paul Devenny, and Jeffrey Schneider voted in favor of the Motion. The Application was approved with conditions.

Owner/Applicant: Phillip Martinez

Request: The Application of Phillip Martinez, requesting a variance, was presented to the Board. The Application requested a setback variance to allow an existing house and a proposed addition to be located 2 feet from the side property line rather than the required minimum of 5 feet, and also to allow an addition on the house to be located 85 feet from the centerline of N. Overland Trail rather than the required minimum of 100 feet in the O-Open zone.

 

Action: Peter Bohling moved and Paul Devenny seconded the Motion to approve the Application with conditions. Board members Carol Dowding, Peter Bohling, Alan Cram, Paul Devenny, and Jeffrey Schneider voted in favor of the Motion. The Application was approved with conditions.

Owner: MRH Properties, LLC

Applicant: Kobey Northen

Request: The Application of Kobey Northen, requesting a variance was presented to the Board. The Application requested a setback variance to allow an existing building to remain 36 feet from Lincoln Avenue rather than the required minimum of 100 feet from the side lot line and to allow an addition to the building to be located 2.4 feet from the side lot line rather than the required minimum of 10 feet in the I-Industrial zone.

 

Action: Peter Bohling moved and Paul Devenny seconded the Motion to approve the Application with conditions. Board members Carol Dowding, Peter Bohling, Alan Cram, Paul Devenny, and Jeffrey Schneider voted in favor of the Motion. The Application was approved with conditions.

Owner: Dale Schmaltz

Applicant: Marrion Irons

Request: The Application of Dale Schmaltz, requesting a variance was presented to the Board. The Application requested a setback variance to allow a new garage and roof overhang to be 6 5 and 1 3 respectively from the south side property line rather than the required minimum of 7 feet in the R-Residential zone.

 

Action: Carol Dowding moved and Jeffrey Schneider seconded the Motion to approve a new garage to be located 65 from the south side property line and roof overhang to be 2 from the south property line. Board members Carol Dowding, Peter Bohling, Alan Cram, Paul Devenny, and Jeffrey Schneider voted in favor of the Motion. The Application as modified was approved with conditions.
