MINUTES OF THE BOARD OF COUNTY COMMISSIONERS

Monday, JANUARY 13, 2003

LAND USE HEARING

The Board of County Commissioners met at 3:00 p.m. for a Land Use Hearing; Chair Bender presided and Commissioners Gibson and Rennels were present. Also present were Jeannine Haag, Assistant County Attorney; Rob Helmick, and Geniphyr Ponce-Pore, Planning Department; Doug Ryan, Health Department; and Gael Cookman, Recording Clerk.

Chair Bender called the meeting to order with the Pledge of Allegiance; he then asked for public comment on the County Land Use Code. No one addressed the Board for public comment. Chair Bender then presented the 2002 Environmental Advisory Board Stewardship Award to Gina Harvey for the Wild for Life program she developed in which she nurses orphaned fawns and other hoofed animals back to health and then releases them back to the wild. The Board then presented a five-minute video of Ms. Harvey explaining the program and working with the animals.

Chair Bender noted that the following item was on consent and would not be discussed unless requested by the Board, staff, or members of the audience:

  1. HIAWATHA HEIGHTS LOTS 4-8 BLOCK 4 LOT 1, LOT 3-5, 15-17 BLOCK 5 AMENDED PLAT / 02-S2052:
  2. This is a request to amend the plat of Lots 4-8, Block 4, Lots 1, 3-5, 15-17, Block 5, Hiawatha Heights Subdivision, combining a total of twelve lots, into one lot, and vacate a right-of-way easement. The proposed plat amendment of Lots 4-8, Block 4, Lots 1, 3-5, 15, and 16 Block 5 of the Hiawatha Heights Subdivision to create Lot 1 will not adversely affect any neighboring properties or any County agency. The Amended Plat will not result in any additional lots. The staff finds that the request meets the requirements of the Larimer County Land Use Code. Staff recommendation is for approval of File #02-S2052, the Amended Plat of Lots 4-8, Block 4, Lots 1, 3-5, 15-17, Block 5, Hiawatha Heights Subdivision, subject to the following conditions and authorization for the chairman to sign the plat when the conditions are met and the plat is presented for signature: 1. The Final Plat shall be recorded by June 13, 2003 or this approval shall be null and void. 2. Technical corrections requested by Larimer County Engineering shall be made prior to recordation of the plat.

    M O T I O N

    Commissioner Gibson moved that the Board of County Commissioners approve of the Amended Plat for Hiawatha Heights Lots 4-8 Block 4 Lot 1, Lot 3-5, 15-17 Block 5, file # 02-S2052, as outlined above.

    Motion carried 3-0.

    Mr. Helmick recommended that the Board also place the tabled item concerning the X Bar Seven Subdivision Lots 27 & 28 Amended Plat, Right of Way, and Easement Vacation on consent; he explained that the only reason this was not placed on consent is because it had been a previously tabled item. Chair Bender asked the Board and members of the audience if they wished to discuss the following item:

  3. X BAR SEVEN SUBDIVISION LOTS 27 & 28 AMENDED PLAT/RIGHT OF WAY AND EASEMENT VACATION / 02-S2032

The request is to amend the plat of X-Bar Seven Subdivision to vacate the common lot line between Lots 27 and 28, the utility easement that lies along the proposed vacated lot line, and a portion of the right-of way easement that serves these lots. The right-of-way will be replatted to best serve the proposed lot. The proposed plat amendment of Amended Plat of X-Bar Seven Subdivision for Lots 27 and 28, and Utility and Right-of-way Easement Vacation will not adversely affect any neighboring properties or any County agency. The Amended Plat will not result in any additional lots. The staff finds that the request meets the requirements of the Larimer County Land Use Code. Staff recommendation is for approval of File #02-S2032, the Amended Plat of X-Bar Seven Subdivision for 27 and 28, with a Utility and Right-of-way Easement Vacation, subject to the following conditions and authorization for the Chair to sign the plat when the conditions are met and the plat is presented for signature: 1. The Final Plat shall be recorded by June 13, 2003 or this approval shall be null and void. 2. Technical corrections to the plat, as required by Dale Greer of Larimer County Engineering, shall be made prior to recordation of the plat.

There was no discussion of this item.

M O T I O N

Commissioner Rennels moved that the Board of County Commissioners approve File #02-S2032, the Amended Plat of X-Bar Seven Subdivision for Lots 27 and 28, and the Utility and Right-of-way Easement Vacation with two conditions as recommended by staff, and authorization for the Chair to sign the plat when the conditions are met and the plat is presented for signature.

Motion carried 3-0.

The meeting adjourned at 3:20 p.m.
